1. Introduction & Acceptance of Terms
These Terms and Conditions constitute a legally binding agreement between M Tech Calibration Lab LLP (hereinafter referred to as the "Company", "Lab", "we", "us", or "our") and the client or entity requesting services (hereinafter referred to as the "Client" or "Customer").
By issuing a Purchase Order, submitting an instrument for calibration, or utilizing our on-site metrology services, the Client explicitly agrees to be bound by these terms. These terms supersede any prior agreements, oral or written, and override any conflicting terms printed on the Client's purchase documentation unless explicitly agreed to in writing by authorized personnel of the Company.
2. Scope of Services & Compliance
The Company provides dimensional, thermal, mechanical, electrical, and pressure calibration services in strict compliance with the international standard ISO/IEC 17025:2017. All operations fall under our official NABL Accreditation (Certificate No: CC-4184).
- Service Limitations: Services will only be rendered for instruments explicitly listed in the agreed-upon quotation or service order. Additional instruments sent without prior notice will require a separate quotation and may delay processing.
- Methodology: Unless the Client specifies and the Lab agrees to a proprietary calibration method, the Company will select the most appropriate standard operating procedure based on national/international standards and manufacturer specifications.
- Right of Refusal: The Company reserves the right to refuse service for instruments deemed unsafe, heavily contaminated, obsolete, or damaged beyond viable repair/calibration capability.
3. Client Responsibilities & Equipment Handling
To ensure a seamless calibration process and the safety of our technicians, the Client must adhere to the following responsibilities:
- Decontamination: All instruments exposed to hazardous, biological, chemical, or radioactive substances must be thoroughly decontaminated before arriving at our facility. The Client assumes full liability for any harm caused by undeclared hazardous materials.
- Accessories & Manuals: Clients must provide all necessary power supplies, specialized cables, probes, or operating manuals required to power and operate the instrument.
- Packaging & Transport: The Client is solely responsible for packaging the equipment securely to prevent transit damage. The Company holds no liability for instruments damaged during inward or outward transit handled by third-party couriers.
4. Pricing, Quotations & Payment Terms
Our commitment to transparent pricing relies on accurate information provided by the Client. The following financial terms apply:
- Quotation Validity: Written quotations are valid for 30 days from the date of issue unless stated otherwise.
- Taxation: All quoted prices are exclusive of Goods and Services Tax (GST) and any other applicable government levies, which will be added to the final invoice.
- Payment Terms: Standard payment terms are Net 30 days from the invoice date for approved corporate accounts. For non-account holders, payment is required prior to the dispatch of instruments or issuance of digital certificates.
- Late Payment Penalties: Payments delayed beyond the agreed terms may incur an interest charge of 1.5% per month on the outstanding balance, along with the immediate suspension of ongoing services.
5. Turnaround Time & Force Majeure
While M Tech Calibration strives to maintain an average 24 to 72-hour turnaround time, all delivery dates are estimates provided in good faith.
The Company shall not be held liable for any direct, indirect, or consequential losses (including loss of production or profit) resulting from delays in calibration, repair, or logistics. Furthermore, the Company is exempt from liability in cases of Force Majeure, including but not limited to natural disasters, government restrictions, severe supply chain disruptions, or catastrophic equipment failures within the laboratory.
6. Certificates, Reports & Validity
Upon completion of services, the Company issues a detailed calibration certificate bearing the NABL symbol (if the instrument falls under our accredited scope).
- Data Integrity: The calibration results apply strictly to the instrument at the time of testing and under the stated environmental conditions. The Company does not guarantee the long-term drift or future performance of the instrument.
- Alterations: Any unauthorized alteration, modification, or partial reproduction of the calibration certificate renders it immediately null and void.
- Re-issuance: If the Client requests a certificate modification due to an error on their part (e.g., incorrect company name or ID number provided), an administrative re-issuance fee will apply.
7. Limitation of Liability & Warranties
The Company warrants that all services will be performed with the highest degree of professional metrological skill and care. However, our liability is strictly limited:
Under no circumstances shall the total liability of the Company, whether in contract, tort (including negligence), or otherwise, exceed the total fee paid by the Client for the specific calibration service that gave rise to the claim.
The Company expressly disclaims any liability for indirect, incidental, punitive, or consequential damages, including loss of data, loss of use, downtime, or product recalls initiated by the Client based on instrument readings.
8. Confidentiality & Data Protection
The Company treats all Client information, proprietary instrument designs, and calibration test results as highly confidential. Test results will not be disclosed to any third party without the explicit written consent of the Client, except where mandated by law or requested by the National Accreditation Board for Testing and Calibration Laboratories (NABL) during official audits.
9. Refund & Cancellation Policy
Due to the specialized nature of metrology services, our refund and cancellation policies are strict:
- Pre-Service Cancellation: If a Client cancels a service order before any laboratory work or preliminary testing has commenced, a full refund (minus administrative or inward shipping costs) will be issued.
- In-Process Cancellation: Once an instrument has been staged, pre-checked, or entered into the testing sequence, cancellations will incur a prorated fee based on the labor and resources already expended.
- Completed Services: No refunds are provided for completed calibrations. If an instrument fails calibration due to intrinsic defects, the calibration fee remains fully payable as the labor of testing has been fulfilled.
- Disputes: If a Client contests the accuracy of a calibration, they must notify the Company within 7 days of receiving the instrument. If a re-test proves the original calibration was flawed due to laboratory error, a free re-calibration or refund will be provided.
10. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms, or the services provided by the Company, shall be subject to the exclusive jurisdiction of the competent courts located in Faridabad, Haryana.
